Welcome to the Information Website for the Canadian Air Cargo Settlements

If you purchased Airfreight Shipping Services between January 1, 2000, and September 11, 2006, you could be affected by Class Action Settlements in Canada. "Airfreight Shipping Services" are air cargo shipments within, to, or from Canada (except to/from the United States).

New Settlements

Settlements were reached with British Airways PLC (“British Airways”) and Air Canada. The settlements are subject to court approval. If approved, the settlements will resolve the litigation in its entirety.

Under the terms of their settlement agreements, British Airways agreed to pay CAD$9,000,000 and Air Canada agreed to pay CAD$7,000,000 in exchange for a full release of the claims against them relating to the alleged price-fixing of Airfreight Shipping Services.

The settlement funds are payable in three installments, October 2020, April 2021 and October 2021. The settlements funds received to date (plus interest, less court-approved fees and expenses) are being held in trust for the benefit of settlement class members. At the approval hearings, the courts will be asked to approve a method of distributing the settlement funds to settlement class members.

Copies of the settlement agreements and proposed distribution protocol are available on the Important Documents page.

Please review this site periodically for continuing updates regarding the Settlements.

Previous Settlements

Previous settlements, totalling approximately $29.6 million, were reached with twelve groups of defendants. The settlement funds were distributed to qualifying Settlement Class Members in January 2019. For more information, visit the Important Documents page.
